As you will see in the comprehensive, summary information text prepared specifically for our members below, and in the training standards file shared in the appendix: Physicians who do not participate in the Certified Gastrointestinal System Endoscopy Training program prepared by TUK and subsequently do not take the examination cannot perform \u201cConventional Endoscopy\u201d procedu<\/strong>res.<\/strong> (It is mandatory that at least one of the trainers providing training in this program is a Gastroenterology specialist and that the training is under the supervision of a Gastroenterologist.)<\/p>\n

For ERCP, EUS, EMR, ESD advanced endoscopic procedures:<\/strong> The decision of the Council of State that general surgery and internal medicine specialists cannot perform these procedures is final.<\/strong><\/p>\n

If it is detected that these procedures are being performed in your units, it is necessary to notify the authorized unit directly and have them stopped. \nREGARDING THE GASTROINTESTINAL SYSTEM (GIS) ENDOSCOPY CERTIFIED TRAINING PROGRAM:<\/strong><\/p>\n

In accordance with the Ministry of Health’s Certified Training Regulation, the Gastrointestinal System (GIS) Endoscopy Certified Training Program has been prepared by the relevant Certified Training Scientific Committee. The purpose of this program is to provide general surgery and internal medicine specialists with the competence to perform endoscopic procedures related to the gastrointestinal system within the framework of national and international scientific studies and practices.<\/p>\n

In Article 5\/18, titled \u201cPROCEDURES AND PRINCIPLES FOR THE IMPLEMENTATION OF THE CERTIFIED TRAINING PROGRAM,\u201d of the Gastrointestinal System (GIS) Endoscopy Certified Training Program:<\/p>\n

\u201cThe lists of trainers to take part in the CTP are prepared in accordance with the trainer qualifications specified in the standards. In case of a trainer change, this situation is reported to the provincial health directorate at least 2 weeks before the start of the CTP, and then the change is checked by the provincial health directorate and forwarded to the relevant unit. If trainer changes occur due to force majeure after the CTP has started, the provincial health directorate and the relevant unit are notified on the day the change occurs.\u201d is regulated.<\/p>\n

According to Article 8, titled \u201cTRAINERS AND THEIR QUALIFICATIONS IN THE CERTIFIED TRAINING PROGRAM\u201d: <\/p>\n

\u201cThose who possess one of the following qualifications are assigned as trainers in the CTP:
\n1-Physicians who are trainers in one of the subspecialties of Gastroenterology and Gastroenterological Surgery,
\n2-Physicians who are trainers in one of the main branches of General Surgery and Internal Medicine and hold a Gastrointestinal System Endoscopy Certificate.
\n3-All endoscopy trainers in the training center participate in the training.\u201d<\/p>\n

According to Article 9, titled RESPONSIBLE FOR THE CERTIFIED TRAINING PROGRAM AND QUALIFICATIONS: <\/p>\n

\u201cThe program director for the practical training of the CTP must possess the trainer qualifications defined in Article 8 of the standard.\u201d<\/p>\n

In Article 10\/9, titled QUALIFICATIONS OF THE CERTIFIED TRAINING CENTER, <\/p>\n

The practical training center where the Gastrointestinal System Endoscopy Certified Training Program will be conducted must meet the qualifications specified below; to become a training center, there must be at least 2 trainers from at least 2 different branches (general surgeon, gastroenterologist, or gastroenterological surgeon). If these conditions cannot be met in the training institution applying to be a training center, it should apply by making a protocol with another training institution. <\/p>\n

With the regulation in question, the center where the certification training will be conducted must absolutely have at least 2 trainers from at least 2 different branches. More clearly, there must absolutely be a gastroenterologist or a gastroenterological surgeon in the center. The absence of a gastroenterologist or a gastroenterological surgeon trainer in a center providing CTP training means that it does not meet the conditions to function as a training center. Such centers are not authorized to issue certificates, and the certificates issued by them have no validity according to the aforementioned regulation. <\/p>\n

It would be appropriate to request that the necessary action be taken by notifying the T.C. Ministry of Health, General Directorate of Health Services, Department of Education and Certification, that centers found to be in the stated situation have lost their qualification as a center.<\/p>\n

REGARDING THE DECISION OF THE 10TH CHAMBER OF THE COUNCIL OF STATE DATED 25.10.2022, FILE NO. 2019\/9999 E., DECISION NO. 2022\/4662 K., STATING THAT GENERAL SURGEONS AND INTERNAL MEDICINE SPECIALISTS CANNOT PERFORM ERCP, EUS, EMR, ESD: <\/strong><\/p>\n

The lawsuit we filed against the Ministry of Health, with the Council of State 10th Chamber’s file no. 2019\/9999 E., seeking the annulment of the implicit rejection by the defendant administration of our Society’s application \u201cfor the preparation of the necessary DIRECTIVE stating that general surgeons and internal medicine specialists cannot perform ERCP, EUS, EMR, ESD, and its distribution to all state, university, and private hospitals,\u201d resulted in our favor with the decision dated 25.10.2022, decision no. 2022\/4662 K.; <\/p>\n

\u201cThe implicit rejection of the application made to the Ministry of Health on 02\/04\/2018 for the preparation of a directive stating that general surgery and internal medicine specialists cannot perform advanced endoscopic techniques such as “ERCP, EUS, EMR, EDS” and its distribution to all state, university, and private hospitals is hereby ANNULLED.\u201d<\/p>\n

\u201c\u2026Although it is argued that a decision was made by the Medical Specialization Board on 02-03\/01\/2014 with decision number 407 regarding who can perform gastrointestinal endoscopic procedures, and that general surgery and internal medicine specialists, in addition to gastroenterology, gastroenterological surgery, pediatric surgery, and pediatric gastroenterology specialists, can also perform these procedures if they possess an endoscopist certificate registered by the Ministry of Health, and that the procedures and principles for issuing endoscopist certificates were determined by the Endoscopist Certification Commission established within the Medical Specialization Board, and that ERCP, EUS, EMR, and ESD applications were excluded from the scope due to requiring advanced endoscopic techniques, and thus the defendant administration did not need a new regulation regarding the procedures subject to the lawsuit, and that the aforementioned decision of the Medical Specialization Board is a rule-making regulatory act, it is concluded from the case file that, with the letter dated 06\/07\/2018 and numbered E.2056 from the Ministry of Health, General Directorate of Health Services, it was stated to the Antalya Provincial Health Directorate that general surgery specialists cannot perform ERCP-related tasks and procedures according to their core curriculum and the Medical Specialization Board’s decision number 457, but they could perform ERCP-related tasks and procedures if they received training within the framework of the Ministry of Health’s Certified Training Regulation outside of their core curriculum and improved their training level through in-service training, and subsequently, general surgery specialists were allowed to work in ERCP units. Furthermore, considering the announcements that \u201cBasic ERCP Training\u201d would be initiated within the T\u00fcrk Cerrahi Derne\u011fi by Istanbul Training and Research Hospital, Afyon Kocatepe University Faculty of Medicine, Bak\u0131rk\u00f6y Training and Research Hospital, and Trakya University Faculty of Medicine, Department of General Surgery, and certificates would be issued at the end of the training, it is concluded that there is no unity in practice regarding the procedures excluded from the scope of the Medical Specialization Board’s decision dated 02-03\/01\/2014 and numbered 407; on the contrary, deficiencies have arisen, there is no clarity regarding which specialists can perform the said procedures, and this situation poses a threat to public health and safety.\u201d
\nIn this situation, it is clear that the defendant administration, which is obliged to prioritize the provision of quality health services and efficiency without causing resource waste and idle capacity, within its authority to determine which specialist physician or physicians can or cannot perform health practices, must ensure uniformity across the country regarding whether general surgery and internal medicine specialists can perform “ERCP, EUS, EMR, EDS” procedures requiring advanced endoscopic techniques, and eliminate confusion in practice for public health and service requirements. Therefore, the contested action of implicitly rejecting the application made by the plaintiff Society, instead of accepting it and taking action on the matter and announcing it, is not in accordance with the law. \u2026 is stated.\u201d <\/p>\n

As can be understood, the Council of State has ruled that general surgery and internal medicine specialists cannot perform “ERCP, EUS, EMR, EDS” procedures requiring advanced endoscopic techniques.<\/strong><\/p>\n
